Terms of Service

1. Introduction

Welcome to LensPal. These Terms of Service ("Terms") govern your use of the LensPal mobile application (the "App") and any related services provided by us. By downloading, installing, or using our App, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access or use our App.

2. Definitions

Throughout these Terms, the following terms shall have the meanings defined below:

• "App" refers to the LensPal mobile application.
• "User," "you," and "your" refer to the individual accessing or using the App.
• "We," "us," and "our" refer to LensPal and its operators.
• "Content" refers to all text, images, graphics, photographs, audio, video, and other materials that may be available on the App.

3. App License

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App for your personal, non-commercial purposes on a single mobile device that you own or control.

You may not:

• Copy, modify, or create derivative works based on the App
• Distribute, transfer, sublicense, lease, lend, or rent the App to any third party
• Reverse engineer, decompile, or disassemble the App
• Remove, alter, or obscure any proprietary notice or label on the App
• Use the App in any way that violates applicable laws or regulations

4. User Accounts

Some features of the App may require you to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

We reserve the right to suspend or terminate your account at our discretion, without notice, if we believe you have violated these Terms or for any other reason.

5. User Content

Our App may allow you to create, upload, or share content. You retain all rights to your content, but you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, and distribute your content in connection with the App.

You are solely responsible for your content and the consequences of sharing it. You represent and warrant that:

• You own or have the necessary rights to use and authorize us to use your content
• Your content does not violate the privacy, publicity, intellectual property, or other rights of any person
• Your content does not contain any material that is defamatory, obscene, offensive, or otherwise objectionable

6. Intellectual Property

The App, including its content, features, and functionality, is owned by LensPal or its licensors and is protected by copyright, trademark, patent, and other intellectual property laws. These Terms do not grant you any right, title, or interest in the App or its content, other than the limited license described above.

All trademarks, service marks, logos, and trade names displayed on the App are the property of their respective owners.

7. Prohibited Activities

You agree not to engage in any of the following prohibited activities:

• Using the App for any illegal purpose or in violation of any local, state, national, or international law
• Harassing, threatening, or intimidating other users
• Impersonating any person or entity, or falsely stating or misrepresenting your affiliation with a person or entity
• Interfering with or disrupting the App or servers or networks connected to the App
• Attempting to gain unauthorized access to any portion of the App or any other systems or networks connected to the App
• Using any automated means, including bots, scrapers, or spiders, to access the App or collect data from the App
• Introducing any viruses, Trojan horses, worms, logic bombs, or other harmful material to the App

8. Third-Party Services

The App may contain links to third-party websites or services that are not owned or controlled by us. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that we shall not be responsible or liable for any damage or loss caused by your use of any such websites or services.

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE APP IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE APP.

11. Indemnification

You agree to defend, indemnify, and hold us harmless from and against any claims, liabilities, damages, losses, and expenses, including without limitation reasonable attorney's fees and costs, arising out of or in any way connected with your access to or use of the App or your violation of these Terms.

12. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our App after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the App.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Cyprus, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts located in Cyprus.

14. Severability

If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
